The Condominium known as Villa Santa Fe is governed by the Declaration of Horizontal Property Regime and of Covenants, Conditions and Restrictions for Villa Santa Fe, recorded at Recording Number 83-107165, in the Official Records of Maricopa County, Arizona Recorder, and any amendments thereto (the Declaration). Villa Santa Fe, Inc. (the Association) cannot set assessments to keep up with inflation and increased costs under the current language of the Declaration. Section 15 of the Declaration limits raising the annual assessment by 3% of the previous year. This amendment allows the Board to increase the maximum annual assessment by an amount up to four percent (4%) over the prior years maximum annual assessment. If the Board determines that an increase in the annual assessment to an amount that is greater than four percent (4%) over the prior years assessment is necessary, then the Board would have to put such increase out to a vote of the membership. Such increase would only be adopted if a majority of the members voting voted in favor. PROPOSED AMENDMENT Section 15, including 15.1, 15.2, 15.3 would be deleted and replaced in its entirety as follows: 15.1 Maximum Annual Assessment. The maximum annual assessment may be increased each year not more than four percent (4%) above the maximum annual assessment for the previous year without a vote of the membership. 15.2 The maximum annual assessment may be increased each year by an amount in excess of four percent (4%) above the prior years maximum annual assessment by a vote of a majority of the members who are voting (in person or by absentee ballot) at a meeting called for such purpose at which quorum is present. Quorum for a meeting held for the purpose shall be Owners holding thirty percent (30%) of the eligible votes in the Association.
