Villa Santa Fe, Inc. (the Association) cannot set assessments to keep up with inflation and increased costs under the current language of the Declaration. Section 15 of the Declaration limits raising the annual assessment by 3% of the previous year. The purpose of this written consent form is to approve the amendment below allowing the Association?s Board to set assessments in the budget, subject to the ratification (or rejection) of Unit Owners at a meeting. This ratification process is the same procedure set forth in the Arizona Condominium Act, A.R.S. 33-1243(D). If the amendment is approved, there will not be a cap on the maximum annual assessment, but all increases in assessments will be subject to the ratification of the Owners. Your participation in this process is important.
