The outcome of this vote will determine whether the Copper Creek Community Association (HOA) will continue to have jurisdiction over these matters or if all related parking complaints will need to be directed to the City of Phoenix. Overview of A.R.S. 33-1818 Under Arizona Revised Statutes A.R.S. 33-1818, the authority of community associations over public roadways is clearly defined. The HOA can continue to regulate public roadways until June 30, 2025, after which a vote must be held to continue to enforce. If a quorum is present and a majority of members vote to continue regulation, the HOA retains its authority. This decision must be recorded with the county recorder. If the vote fails or is not held, the HOA loses its authority over public roadways, and existing regulations expire. The statute does not apply to one-way streets or private roads, regardless of ownership. Importance of Your Vote The HOA will hold a meeting of the Members on June 9, 2025 to vote on whether to continue enforcing parking regulations on public roads within the community. It is crucial for all members to participate in this vote to ensure that the outcome reflects the collective will of the community. If the Vote Succeeds: The HOA will retain its authority to regulate parking on public roads, ensuring consistent enforcement of our communitys standards. If the Vote Fails: The HOA will lose jurisdiction over public roadways, and any parking-related complaints will need to be directed to the City for resolution. This means that the HOA will no longer be able to address or enforce parking issues on these roads. Accordingly, owners would then be able to park any vehicle on the road, including boats, trailers, commercial vehicles, large trucks, etc. with no recourse for the Association to take against those owners. The City may enforce any applicable local ordinances, but it is unclear what will be the extent of the Citys enforcement.
