The Association regulates public roadways within the Association, as further set forth in the Declaration of Covenants, Conditions, and Restrictions. The purpose of this notice is for HOA Members to vote to decide whether The Canterra Court Homeowners Association, A/K/A Pecan Groves (?Association?) should retain its authority to regulate public roadways within the community. Legislative action enacted through the A.R.S. ? 33-1818(B)(1), provides that ?Not later than June 30, 2025, the planned community shall call a meeting of the membership on the question of whether to continue to regulate public roadways.? The Association includes streets that were dedicated to the public, pursuant to the Declaration of Convents, Conditions, Restrictions (?CC&Rs?) for The Canterra Court Homeowners Association, A/K/A Pecan Groves and the Final Plat. In order to retain authority to regulate the public roadways, the Association must obtain approval from members representing a majority of votes of those voting. The Board has set June 27th, 2025 5:00PM as the HOA date for counting the membership ballots. Quorum for this meeting shall be the results of voting, either via absentee ballot or electronic voting, of members entitled to cast ten percent (10%) of the eligible votes of the Association (See Article III, Section 4 of the Bylaws.). How This Vote Affects the Association If the proposed measure is not approved: The Association will permanently forfeit all authority over any portions of the community that have been or will be dedicated to the public, including the roadways, curbs, and adjacent rights-of-way. Once that control is gone, the Board will have no legal basis to enforce any of its restrictions in the CC&Rs or Rules on those areas. Owners, tenants, and guests would be free to park cars, commercial trucks, trailers, boats, motor homes, or other recreational vehicles on the streets for any length of time, place trash and recycling cans at the curb indefinitely, store construction materials, put their furniture on the road while moving in or out, or engage in other activities that our governing documents currently restrict. Because the Association would lack jurisdiction, it could neither issue violation notices nor levy fines, leaving the community dependent on over-burdened municipal code-enforcement officers for any remedy. The resulting loss of uniform standards risks increased street congestion, diminished home curb appeal, and potential decline in property values, and compromised neighborhood safety. The Canterra Court Homeowners Association, A/K/A Pecan Groves Board supports maintaining the Association?s authority to maintain roadways as essential to preserving the quality, appearance, and overall integrity of our community.
